Terms of Service

PullRate is a marketplace that connects buyers and sellers of Pokémon TCG products. We are not a party to transactions between buyers and sellers — we provide the platform, payment processing infrastructure, and dispute resolution services. We are not affiliated with, endorsed by, or sponsored by The Pokémon Company, Nintendo, or any of their subsidiaries.

All references to Pokémon, Pokémon card names, set names, and related intellectual property belong to their respective owners. Card data and images used for listing identification are sourced from publicly available databases and used for identification purposes only.

You must be at least 18 years old to create an account and use the platform. By registering, you represent that:

• You are at least 18 years of age
• You are legally permitted to enter into contracts in your jurisdiction
• You will provide accurate, current, and complete information during registration
• You will maintain the security of your account credentials

We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

If you list items for sale on PullRate, you agree that:

• You own the items you list. You have clear title to every item you list and the right to sell it.
• Your listings are accurate. Photos, condition grades, and descriptions must honestly represent the actual item. Condition grades follow standard TCG grading conventions (NM, LP, MP, HP, DMG).
• No counterfeit or proxy cards. Listing counterfeit, proxy, or altered cards as genuine is strictly prohibited and will result in immediate account termination, forfeiture of any pending payouts, and referral to relevant authorities where appropriate.
• No stolen goods. You must not list items that are stolen or obtained through fraud.
• You will ship promptly. You agree to ship sold items within 3 business days of payment confirmation and provide valid tracking information.
• You are responsible for shipping. You are responsible for packing items securely and for any damage that occurs during transit due to inadequate packaging.
• Fees. You agree to pay our platform fee on each completed sale as described in our Fees page.

If you purchase items on PullRate, you agree that:

• Payment is binding. When you complete checkout, you are entering into a binding purchase agreement with the seller. Purchases cannot be cancelled once payment is confirmed unless the seller agrees or a dispute is opened.
• Provide accurate shipping information. You are responsible for any failed deliveries due to an incorrect shipping address provided at checkout.
• Confirm delivery promptly. You agree to confirm delivery within 7 days of the tracking information showing delivered. Failure to confirm delivery within 14 days of the expected delivery date will result in automatic delivery confirmation and payout release to the seller.
• Disputes must be filed in good faith. Abuse of the dispute system, including false claims, may result in account suspension.

Payments are processed by Stripe, Inc. By making a purchase or receiving a payout, you agree to Stripe's Terms of Service.

Buyer funds are held in escrow from the time of payment until delivery is confirmed. Funds are not released to the seller until the buyer confirms receipt or the automatic confirmation period elapses.

Seller payouts are subject to a hold period based on the seller's trust tier (3–14 days from confirmed delivery). This hold period exists to allow time for disputes to be opened before funds are released. Payout timing is also subject to Stripe's standard processing times.

Platform fees are non-refundable once a transaction is complete, except in cases where a dispute is resolved in the buyer's favour, in which case the full purchase amount is refunded.

We are not responsible for delays in payouts caused by Stripe, banking institutions, or factors outside our control.

PullRate offers buyer protection on all transactions. If you receive an item that is significantly not as described, counterfeit, or do not receive your item at all, you may open a dispute within 30 days of the estimated delivery date.

Disputes are reviewed by our team. We may request:

• Photos of the item received
• Shipping and tracking evidence
• Any relevant communication between buyer and seller

Our dispute resolution decisions are final. We reserve the right to resolve disputes in favour of either party based on the evidence provided. Outcomes may include full refund, partial refund, or payout release to the seller.

Buyer protection does not cover:

• Items accurately described in the listing that the buyer changed their mind about
• Damage caused after delivery
• Disputes filed more than 30 days after the estimated delivery date
• Disputes where the buyer provided an incorrect shipping address

The following are prohibited on PullRate:

• Counterfeit, proxy, or altered cards represented as genuine
• Stolen goods
• Graded cards where the stated grade does not match the certification
• Listings with intentionally misleading photos or descriptions
• Circumventing the platform to complete transactions off-platform with buyers or sellers met through the marketplace
• Creating multiple accounts to circumvent suspensions or trust tier limits
• Manipulating ratings or reviews
• Harassment of other users
• Any activity that violates applicable law

Violations may result in listing removal, account suspension, forfeiture of pending payouts, and reporting to law enforcement where appropriate.

Sellers on PullRate are assigned a trust tier (1–3) that determines listing limits, maximum listing values, and payout hold periods. Tiers are based on completed sales history, account age, dispute rate, and identity verification. We reserve the right to adjust tier criteria, change a seller's tier, or suspend a seller's account at our discretion.

All content on PullRate — including our logo, design, software, and original text — is owned by or licensed to us and protected by copyright and trademark law. You may not reproduce, distribute, or create derivative works without our written permission.

By uploading photos to PullRate, you grant us a non-exclusive, royalty-free, worldwide license to display those photos on the platform for the purpose of facilitating your listing. You represent that you own or have the right to use any photos you upload.

Pokémon, all Pokémon character names, and related marks are trademarks of The Pokémon Company. PullRate is not affiliated with or endorsed by The Pokémon Company, Nintendo, Game Freak, or Creatures Inc.

To the maximum extent permitted by applicable law, PullRate and its operators shall not be liable for:

• The quality, authenticity, or condition of items sold on the platform
• Loss or damage arising from disputes between buyers and sellers
• Delays in shipping or delivery by third-party carriers
• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, revenue, data, or goodwill

Our total liability to you for any claim arising out of or relating to these Terms or your use of the platform shall not exceed the greater of (a) the amount of fees paid by you to us in the 12 months preceding the claim, or (b) $100.

You agree to indemnify, defend, and hold harmless PullRate and its operators from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the platform, your listings, your purchases, or your violation of these Terms.

We may suspend or terminate your account at any time for violation of these Terms, conduct harmful to the platform or its users, or for any other reason at our discretion. Upon termination, any pending transactions will be completed or cancelled in accordance with these Terms. Any funds owed to you as a seller at the time of termination will be paid out subject to the standard hold period, unless your account was terminated for fraud or policy violations, in which case pending payouts may be forfeited.

You may close your account at any time by contacting us at support@pullrate.gg. Closing your account does not affect any outstanding transactions.

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.

We may update these Terms from time to time. We will notify registered users of material changes by email or by a prominent notice on the platform. Continued use of the platform after changes take effect constitutes acceptance of the revised Terms.
